In April 2014, the International Law Association (ILA) adopted draft articles on existing legal principles related to climate change. These annotated draft articles, prepared by eminent jurists, provide possible guidelines for States in their joint efforts to combat climate change and negotiate a new international agreement. The ILA notes that the general principles of international law and international environmental law apply to climate change. States are required to ensure that greenhouse gas emissions within their jurisdiction or control do not cause harm in other States or territories outside their national jurisdiction. States that violate the duty of prevention can be held accountable. However, there are different obligations and rights for developed and developing countries. The legal basis of the ila for climate change clarifies and develops the relevant criteria. Overall, they mark a paradigm shift in favour of “victim states”, which are particularly exposed to the negative effects of climate change. As a result, the traditional beneficiaries of international charity have become creditors with legal rights.
